Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Turnless ("Company", "we", "us", or "our") concerning your access to and use of our AI-powered phone receptionist service (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorised use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Service Description

Turnless provides an AI-powered phone receptionist service that:

  • Answers incoming calls to your business
  • Schedules appointments on your behalf
  • Provides information about your business to callers
  • Records and transcribes calls
  • Integrates with your calendar and other business tools

5. Subscription and Billing

5.1 Free Trial

We may offer a free trial period. You will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel.

5.2 Subscription Fees

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change our pricing with 30 days' notice
  • You authorise us to charge your payment method for all fees

5.3 Usage-Based Charges

Additional charges may apply for usage beyond your plan limits, including call minutes, SMS messages, and API calls.

5.4 Payment Methods

We use Stripe for payment processing. You must provide valid payment information. If payment fails, we may suspend your Service.

6. Cancellation and Termination

6.1 Cancellation by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

6.2 Termination by Us

We may suspend or terminate your access to the Service immediately if you:

  • Violate these Terms
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Use the Service in a way that harms us or other users

6.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will delete your data within 90 days unless required by law to retain it.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt the Service
  • Use the Service to harass, abuse, or harm others
  • Impersonate any person or entity
  • Collect user data without consent
  • Use the Service for spam or unsolicited communications

8. Intellectual Property

8.1 Our Rights

The Service, including all content, features, and functionality, is owned by Turnless and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Rights

You retain all rights to your business data and content. By using the Service, you grant us a licence to use your data solely to provide the Service.

8.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to you.

9. Call Recording and Consent

Our Service records and transcribes calls. You are responsible for:

  • Complying with all applicable call recording laws in your jurisdiction
  • Obtaining necessary consent from callers where required
  • Providing appropriate notice to callers that calls may be recorded

We provide tools to help you comply with these requirements, but you are ultimately responsible for legal compliance.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that the AI will always provide accurate or appropriate responses.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNLESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Turnless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or failure to comply with applicable laws.

13. Governing Law and Disputes

These Terms shall be governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.

  • Entire Agreement: These Terms constitute the entire agreement between you and Turnless
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • Waiver: Failure to enforce any provision does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our control
